GENERAL TERMS AND CONDITIONS OF TRADING AND PARTICIPATION ON THE VIVERE TICKETING PLATFORM (YOU MUST READ AND ACCEPT THEM BEFORE PROCEEDING WITH TICKET PURCHASE)

Welcome! Below are the terms of use that govern your use of the websites, mobile applications, and platforms of Vivere, including but not limited to the website www.vivere.al (collectively, the “Vivere Platform”), as well as your purchase, possession, or use of any ticket from the Vivere Platform, along with any product or service provided by this Platform. Please read these terms carefully before using our service, accessing, utilizing, or obtaining any material, information, products, or services. By accessing the Vivere Website (VWW), the mobile or tablet application, or any other medium or platform (together referred to as “Our Website” or the “Vivere Platform”), you expressly agree to comply with these terms, as they may be amended from time to time.

Interpretation and Definitions

Interpretation

Words with their first letter capitalized have the meanings defined under the following conditions. The definitions below shall have the same meaning regardless of whether they appear in singular or plural.

Definitions For the purposes of these Terms:

  • The Company (referred to as “the Company,” “We,” “Us,” or “Our” in this Agreement) refers to VIVERE TICKETING Sh.p.k, registered in the commercial register on December 1, 2020, with NUIS M02401018M, located in Tirana, Albania.
  • Country refers to Albania.
  • Comments refer to feedback, suggestions, or innovations submitted by You regarding the attributes, performance, or characteristics of our service.
  • Goods/Products/Services (collectively, “Goods”) refer to the items offered for sale through the service, such as event tickets, festival entry tickets, concert tickets, and all other goods or services related to events/festivals/concerts.
  • Orders, Services, and Terms

  • Orders refer to a request made by You to purchase Goods from the Company.
  • Service refers to the Vivere Platform.
  • Vivere Platform refers to an organizational platform that offers tickets for festivals/concerts/events through the internet and mobile applications. Through the Vivere Platform, users can book/purchase tickets for various festivals, concerts, and events. The online offering includes tickets for the respective festival/concert/event and other related services.
  • Commission refers to the fee added to the ticket price for the festival/concert/event, which the Vivere Platform collects in exchange for the provided service. This fee is paid together with the final price but is listed separately on the issued invoice.
  • Terms and Conditions (also referred to as "Terms") mean the conditions that constitute the entire agreement between You and the Company regarding the use of the Service.
  • Service Providers or Third-Party Social Media Services refer to any service or content (including data, information, products, or services) provided by a third party that may appear, be included, or become available through the Service.
  • Website refers to the Vivere Website, accessible at http://www.vivere.al.
  • You refers to the individual accessing or using the Service, or the company or other legal entity on whose behalf such an individual is accessing or using the Service, as applicable.

Acknowledgment/Acceptance

These Terms govern the use of this Service and constitute the legal agreement between You and the Company. These terms define the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, then You may not access the Service. By accessing or using the Service, You declare that You are at least 18 years old. Your access to and use of the Service is also conditioned on your acceptance of and compliance with the Company's Privacy Policy. Our Privacy Policy describes our policies and procedures regarding the collection, use, and disclosure of Your personal information when You use the Platform, Application, or Website, and informs You of Your privacy rights and how the law protects You. Please read our Privacy Policy carefully before using the Service.

Placing Orders/Booking Goods

By placing an Order for Goods through the Service, you guarantee that you are legally capable of entering into binding contracts and that you are at least 18 years old. Your Information/Privacy If you wish to place an Order for Goods available on the Service, you will be required to provide certain essential details regarding your order, including but not limited to:
Your full name
Your email address
Your phone/mobile number
Your country of origin and/or the country from which you are placing the order
Your credit card number, credit card expiration date, billing address, and/or shipping information You declare and guarantee that:
You have the legal right to use any credit or debit card or other payment methods for any Order.
The information you provide is true, accurate, and complete. From this point forward, all such information will be treated as strictly private and confidential, and we will take all necessary steps to maintain its confidentiality. We will not use, copy, or store any such information in an externally accessible computer or similar system, nor will we transmit it within or through any such system. We will use this information only for the permitted purpose and for no other reason. Specifically, but not limited to, we will not use this information to gain any commercial advantage over any company. By submitting such information, You grant us the right to provide it to third parties for payment processing purposes to facilitate the fulfillment of your Order. We will be permitted to disclose this information to third parties/responsible employees for payment processing and to our legal and financial advisors, in cases where such disclosure is appropriate and necessary for the permitted purpose. We will ensure that the recipients of this information, as well as any other party to whom such disclosure has been made, adhere to the terms of this agreement as if they were parties to it themselves. We will maintain a record of the information provided to us, the persons to whom it has been disclosed, the location of such information, and every individual in possession of such information.

Order/Booking Confirmation

You will receive an email confirmation and a coupon immediately after placing your order/booking. You also consent to receiving various emails or phone calls from us, containing important and useful information related to your booking/order. If you do not receive an email from us, please check your Spam/Junk folder or contact us via email for further assistance.

Event Postponement

In the event of a postponement of the concert/festival/event due to force majeure, pandemic, date changes by the artist/group for personal or health reasons, executive orders from State Institutions for public safety reasons, or any other issues that make the execution of the event impossible due to objective and/or organizational reasons, the Company reserves the right to change the date, time, and venue of the concert/festival/event. The public will be notified through mass communication channels. In such cases, tickets remain valid as issued and are neither canceled nor refunded. There is no limit to the number of postponements; the event may be rescheduled multiple times if necessary due to circumstances preventing its execution. Additionally, the Company reserves the right to modify the event’s program. Order/Booking Cancellation We reserve the right to refuse or cancel your Order at any time for reasons including, but not limited to:
Goods availability
Errors in descriptions or pricing of the Goods
Errors in your Order
Other reasonable causes We also reserve the right to refuse or cancel your Order if we suspect fraud, illegal transactions, or unauthorized activity. In the event of an interruption or cancellation of a festival/concert/event due to force majeure, occurring at least 20 minutes after the event has started, the event and the service provided via the ticket shall be considered fully delivered and will not be repeated. In this case, tickets are non-refundable, as the service is deemed provided and completed. Your Right to Cancel Your Order/Booking The Goods purchased can only be returned/canceled in accordance with these Terms. Please read these Terms carefully to understand your rights regarding the cancellation of your order/booking. Regardless of the reason or cause, cancellations result in costly penalties for us, covering fines and fees. As a result, the following penalties and fees will apply to cancellations. If the Company approves a refund for the festival/concert/event ticket, this refund will be processed no later than 90 days from the conclusion of the event. Ticket Refunds & Order Cancellation Policy If a ticket cancellation is approved for a festival/concert/event, the refund will be processed within 90 days from the conclusion of the event. In all cases, the refund will not include the Commission fee, which is non-refundable. The Company does not refund or replace lost or stolen tickets. In cases of severe weather conditions, epidemics, pandemics, date postponements by the performing artist, or unforeseen staff shortages, we may cancel a festival/concert/event. In such cases, we will fully refund only the ticket price, provided that the ticket is returned to us. There will be no additional refund, compensation, or reimbursement beyond the amount paid for the ticket itself, excluding the Commission fee, which remains non-refundable. Your right to cancel an Order applies only to Goods that are returned in the same condition as received. You must also return all product instructions, documentation, and packaging. Goods that have been damaged, altered, or used beyond opening their original packaging will not be eligible for a refund. You must take reasonable care of the purchased Goods while they are in your possession. If a refund is processed, it will be completed following all proper procedures and executed as soon as possible. The refund amount will be transferred to the same credit card used during the original booking. Please note that we cannot be held responsible for delays in refund processing once the refund has been issued from our side. If a refund is to be made, we will process it no later than 90 days from the date on which we canceled the festival/concert/event. The refund will be issued using the same payment method you used for the original Order.

Availability, Errors & Inaccuracies

We continuously update our Goods listings on the Service. However, the available Goods may:
Have incorrect pricing
Be described inaccurately
Be out of stock There may also be delays in updating product information on the Service and across advertisements on third-party websites. We do not and cannot guarantee the accuracy or completeness of any information, including:
Prices
Product images
Specifications
Availability
Services We reserve the right to modify or update any information and to correct errors, inaccuracies, or omissions at any time without prior notice. If a correction affects a service you have purchased, you will be notified as soon as possible regarding this adjustment.

Pricing Policy

The Company reserves the right to modify its prices at any time before accepting an Order. Prices that have already been accepted in an Order may be revised by the Company if an event affects the delivery of Goods, including but not limited to:
Government actions
Changes in economic conditions
Other external factors affecting supply costs Custom Duties & Pricing Adjustments The Company reserves the right to adjust prices after order acceptance in cases where external factors impact the delivery of Goods, such as:
Custom duties
Increased transportation fees
Higher currency exchange costs
Any other issue beyond the Company’s control

Payments

All purchased Goods require a single payment, which includes the Service Commission. Payments can be made using various accepted payment methods, including:
Visa
MasterCard
Affinity Card
American Express
Online payment methods (e.g., PayPal) It is essential to use the exact name and address as registered with your bank to avoid payment failures. Incorrect or missing information may result in unsuccessful payments, for which we are not responsible in case of order/booking delays or failures. Credit and debit cards are subject to validity checks and authorization by the card issuer. If authorization is not received, we will not be responsible for any delays or non-processing of your Order/Booking.

How to Use Your Ticket

You may present your Booking Confirmation (Ticket) either printed or on your mobile device for entry to the festival/concert/event.
Each ticket is valid for a single entry only and up to the date and time of the selected event.
You must keep your ticket throughout the entire duration of the festival/concert/event until the end of the performance.
Holding a ticket does not grant access to additional services, such as food or beverages, which must be purchased separately at the venue.

Tickets Are Non-Transferable

Purchased tickets cannot be transferred to third parties after purchase from the Company.
Reselling, exchanging, or any other form of ticket trading is strictly prohibited.
The Company reserves the right to cancel such tickets if they are resold or transferred.
The Company may refuse entry to any festival/concert/event if the ticket was obtained via transfer or resale.
Canceled tickets due to resale/transfer are not eligible for a refund.

Arrival at the Meeting Point & Compliance with Participation Conditions


You are responsible for arriving on time at the designated meeting point for the festival/concert/event.
You must present a valid ID for entry.
If you are traveling from abroad, you are responsible for carrying the necessary travel documentation (such as a passport, visa, etc.).

Compliance with Health and Safety Measures


You are responsible for adhering to all required health precautions and regulations.
Failure to present valid identification (ID card or passport) may result in denied entry to the event.
You are solely responsible for children aged 10 to 18 attending a festival/concert/event with you.
The Company bears no legal or financial responsibility for children aged 10 to 18 attending the event.
Children under 10 years old are strictly prohibited from attending.
A ticket must be purchased for children aged 10 to 18, the same as for attendees over 18 years old.
The Company reserves the right to deny entry to individuals who:
Are under the influence of alcohol and/or drugs
Carry dangerous or flammable objects (even if they have a valid ticket)

Restrictions on Recording and Security Checks


The use and transportation of audiovisual recording devices is strictly prohibited at the venue.
Filming, photographing, or recording any part of the event is not allowed.
Ticket holders must submit to security checks, including bag inspections, at the entrance and during the event.
Attendees must follow instructions from security personnel and event organizers.
For safety reasons, crowd surfing (jumping into the crowd to be carried hand-to-hand) is strictly prohibited.

Intellectual Property & Content Ownership

The Service and its original content (excluding user-generated content) — including all features and functionalities — remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other intellectual property laws in Albania and internationally.
This includes but is not limited to:
Texts, page titles, technical documentation, images, photos, models, graphics, logos, icons, scripts, product data, music, videos, software, and artistic works
Design, structure, selection, coordination, and expression of the content
Our trademarks and branding elements may not be used for any product or service without prior written consent from the Company.
Other trademarks appearing on the Service belong to their respective owners and may or may not be affiliated, associated, or sponsored by us. We reserve the right to modify the content and features of the Service at any time. Unauthorized attempts to copy, modify, republish, download, post, publicly display, transmit, reproduce, or distribute any content from the Service are strictly prohibited. Protection of Content & Security Features Any unauthorized attempt to copy, modify, bypass, or disable any security feature designed to protect the content of the Service is strictly prohibited.

Data Subject Rights & Personal Data Processing

By using the Service, you consent to the processing of your personal data, including:

Gender This data is processed for the following purposes:
Ensuring the security and availability of our services
Improving our services and communication channels
Marketing and customer relationship management
Contract management

Your Comments & Media Content (Photos, Images, and Recordings)

User-Submitted Comments By submitting any Comments to the Company, you transfer all rights, titles, and interests in those Comments to us. If such a transfer is not legally enforceable, you agree to grant the Company a:
Worldwide, royalty-free, irrevocable, perpetual, and non-exclusive license
Right to use, reproduce, disclose, sublicense, distribute, modify, and exploit your Comments without limitation Photos, Images & Audiovisual Recordings
We regularly capture photographs and videos for promotional and training purposes.
Media companies or TV stations may also request to film or photograph at certain locations.
By attending the festival/concert/event, you acknowledge and agree that you may be filmed or photographed.
You grant the Company a global, royalty-free, irrevocable, perpetual, and non-exclusive license to:
Use, reproduce, disclose, sublicense, distribute, modify, and exploit these images/videos without restriction
Use your image, voice, and appearance for promotional and training purposes All photographs and videos taken at the festival/concert/event (whether digital or analog) are subject to a:
Worldwide, non-exclusive, perpetual, irrevocable, royalty-free license
Granted to the Company for promotional and training purposes Any artistic work or performance containing your photo, image, video, or audio recording, whether sponsored by the Company or created within the event venue, is subject to the same global, royalty-free, irrevocable, perpetual, and non-exclusive license for training and promotional use by the Company. Links to Third-Party Websites Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that the Company is not liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any content, goods, or services available on or through such websites or services. We strongly recommend that you read the terms and privacy policies of any third-party websites or services you visit.

Termination of Service Access

We may suspend or terminate your access to the Service immediately, without liability or prior notice, for any reason, including but not limited to:
Violation of these Terms Upon termination, your right to use the Service ceases immediately.
You will lose the right to request a refund for any paid ticket.

Limitation of Liability

Regardless of the damages you may suffer, the Company's entire liability, as well as that of its Service Providers, shall be limited to the amount you actually paid through the Service.
If you have not purchased anything through the Service, the Company and its Service Providers will not be liable under any circumstances.
To the maximum extent permitted by law, the Company and its Service Providers shall not be liable for any:
Indirect or incidental damages, including but not limited to:
Loss of profits
Loss of data or information
Business interruptions
Physical injury
Loss of privacy arising from or related to:
Use or inability to use the Service
Third-party software or hardware used with the Service
Any provisions of these Terms This exclusion applies even if the Company or its Service Providers were advised of the possibility of such damages and even if a legal remedy fails to achieve its intended purpose.

Prohibited Conduct at the Festival/Concert/Event

The following are strictly prohibited at any festival, concert, or event:
Illegal substances, drugs, or weapons of any kind, including but not limited to:
Pocket knives
Pepper spray or other self-defense sprays
Flammable liquids or items, including aerosols and fireworks The Company will not be liable for any loss, damage, or injury resulting from such prohibited items. The Company reserves the right to remove any participant from the event if their behavior is:
Deemed inappropriate
Perceived as a threat to the safety and well-being of the event and other attendees Participants must keep the venue clean. The Company assumes no legal or financial responsibility for:
Disputes between attendees
Damage or loss of personal belongings during festivals, concerts, or events Disclaimer: "As-Is" and "As-Available" Services The Service is provided on an "As-Is" and "As-Available" basis, with all faults and defects, without any warranty of any kind. To the maximum extent permitted by law, the Company, on behalf of itself, its affiliates, licensors, and service providers, expressly disclaims all warranties, whether:
Expressed or implied
Statutory or otherwise This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as warranties that may arise from:

Performance
Usage or trade practice Without limiting the above, the Company does not warrant or represent that the Service will:
Meet your requirements
Achieve any intended results
Be compatible with other software, applications, systems, or services
Be uninterrupted, secure, or error-free
Meet any performance or reliability standards
Have errors or defects that will be corrected Furthermore, neither the Company nor its service providers make any warranties or representations regarding:
The operation or availability of the Service
The accuracy, reliability, or timeliness of any information provided
Whether the Service, its servers, content, or emails sent on behalf of the Company will be free of:
Viruses
Harmful code
Malware, worms, or time bombs

Infectious Diseases Disclaimer

You assume all risks associated with potential exposure to infectious diseases when attending any festival, concert, or event. This includes, but is not limited to:
Exposure to COVID-19, bacteria, viruses, or other pathogens capable of causing infectious diseases, regardless of:
When the exposure occurs (before, during, or after the event)
How the exposure is contracted By attending, you waive any and all claims against the Company and its affiliates related to such risks.

Insurance Policy

The Company does not and will not provide insurance coverage for:
Business operations or assets
Product liability or professional indemnity The Company does not provide insurance for attendees, including:
Life insurance
Travel insurance
Medical insurance
Liability insurance Any illness, accident, injury, loss, or damage occurring during the festival/concert/event (including related activities) is solely your responsibility.
If you require personal insurance, it is your responsibility to arrange it independently.
Any insurance costs, additional expenses, or unforeseen incidents related to the festival/concert/event are your sole responsibility. If you choose not to attend the festival/concert/event, you will not be entitled to additional compensation or a refund. Additionally, you guarantee that you are not aware of any pre-existing medical conditions or injuries that could pose a risk to yourself or other attendees.
If you have a pre-existing medical condition or injury, you must inform the Company in writing before attending the event.
The Company reserves the right to determine (at its sole discretion) whether you may participate in the festival/concert/event. Governing Law These Terms and Conditions and Your use of the Service shall be governed by the laws of the Republic of Albania, excluding its conflict of law rules.

Dispute Resolution

If you have any concerns or disputes regarding the Service, you agree to first attempt to resolve the issue informally by contacting the Company.
If an informal resolution fails, the competent court for legal claims will be the District Court of Tirana.

Severability (Partial Invalidity Clause)

If any provision of these Terms is found to be unenforceable or invalid, that provision will be:
Modified and interpreted to fulfill its intended purpose to the maximum extent permitted by law
The remaining provisions will continue in full force and effect

Waiver Clause

Except as stated in these Terms, failure to enforce a right or demand performance of an obligation shall not affect a party’s ability to exercise such rights or seek enforcement at a later time.
A waiver of a breach does not constitute a waiver of any subsequent breach.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
By continuing to access or use our Service after any changes take effect, you agree to be bound by the revised Terms.
If you disagree with the updated Terms, in whole or in part, you must stop using the Website and Service.
